Terms of Service

By downloading, installing, or using the Trendspot application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. Users between 13 and 17 must have verifiable parental or guardian consent. By creating an account, you represent that you meet these requirements. We reserve the right to terminate accounts of users who do not meet eligibility criteria.

2. Account

You are responsible for the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at loucas.pignataro@trendspot.com of any unauthorized use. We are not liable for any loss resulting from unauthorized account access.

3. User Content

By uploading videos or any other content to the App (“User Content”), you grant Trendspot a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, display, and distribute your content solely for the purpose of operating and promoting the Service.

You retain full ownership of your content. You represent and warrant that your content does not infringe any third-party rights, including copyright, trademark, or privacy rights, and that you have all necessary rights to grant the above license.

4. Prohibited Conduct

You agree not to post, upload, or transmit any content that:

• Is illegal, defamatory, threatening, or harassing
• Contains nudity, sexual content, graphic violence, or hate speech
• Exploits, endangers, or depicts minors in any inappropriate manner
• Infringes any third-party intellectual property rights
• Contains malware, viruses, or any harmful code
• Impersonates any person or entity

You also agree not to:

• Use the App to engage in any form of spam or unsolicited messaging
• Attempt to reverse-engineer, hack, or disrupt the App’s infrastructure
• Create multiple accounts to circumvent a ban or suspension
• Use automated bots or scripts to interact with the Service

5. Brand Contests

Contests are created by verified brand accounts. Trendspot acts solely as a platform facilitating these contests. Prize fulfillment is the sole responsibility of the brand organizing the contest. Trendspot makes no guarantees regarding prizes.

Winners are determined by the number of likes received on their submitted video at the time the contest closes. Trendspot reserves the right to disqualify entries that violate these Terms or that are suspected of artificial engagement (bots, coordinated liking).

6. Content Moderation & Reporting

We actively moderate the platform. Users may report inappropriate content or accounts directly within the App or by emailing loucas.pignataro@trendspot.com. We review reports promptly and take appropriate action, which may include content removal, account suspension, or reporting to authorities.

7. Account Suspension & Termination

We may suspend or permanently terminate your account at any time, with or without notice, for violation of these Terms, illegal activity, or conduct harmful to the platform or its users. In cases involving illegal content or child exploitation, we will cooperate with law enforcement authorities.

You may delete your account at any time by contacting loucas.pignataro@trendspot.com.

8. Intellectual Property

All elements of the App (design, logo, codebase, features, branding) are the exclusive property of Trendspot and are protected by applicable intellectual property laws. You may not reproduce, modify, or distribute any part of the App without our express written permission.

9. Disclaimer of Warranties

The App is provided “as is” without warranties of any kind. We do not warrant that the App will be error-free, uninterrupted, or free from harmful components. Your use of the App is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Trendspot shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App, including but not limited to loss of data, loss of revenue, or personal injury.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France, unless otherwise required by applicable consumer protection law in your jurisdiction.
